2.1  We try our best to comply with all the data regulations around the world. However, since we are incorporated in Hungary, we are committed to comply with Hungarian data protection regulations as well as adhering to the guidelines set out by the Regulation (EU) 2016/679 ("GDPR").

3.How We Collect Your Data

3.1  The data we collect is provided by the users through their interactions with Solyd and may be collected in the following ways:

3.1.1  Direct Collection:

3.1.1.1  When you provide information by filling out forms, creating an account, subscribing to our services, making inquiries, or otherwise communicating with us.

3.1.1.2  When you engage with our customer support, AI model or interact with us via email, phone, or other communication channels.

3.1.2  Automated Collection (Cookies & Tracking Technologies, together "Cookies"):

3.1.2.1  We automatically collect certain information about your device, browsing actions, and usage patterns when you visit our website. This includes technical data such as IP address, browser type, and operating system.

3.1.2.2  We use cookies and similar tracking technologies to enhance your experience, analyze website performance, and personalize content.

4.Categories of Data We Collect

4.1  We collect the following categories of personal data:

4.1.1  name surname / company name;

4.1.2  type of person / institution;

4.1.3  address;

4.1.4  tax number / VAT number;

4.1.5  email address;

4.1.6  bank account number / crypto wallet address;

4.1.7  information about your device, browsing actions, and usage patterns when you visit our website, including technical data such as IP address, browser type, operating system, and other cookie related data;

4.1.8  other data you provide willingly and are connected to a purchase or services of Solyd.

5.Why We Use Your Personal Data

5.1  We process all data collected by the controller only when there is an appropriate legal basis and for a specific purpose, as defined below. If we process data for a purpose not specified in this policy, we will notify you in advance.

5.2  This Privacy Policy applies to:

5.2.1  Persons who use Solyd's website and/or webshop;

5.2.2  Persons who contact us or our partners regarding Solyd;

5.2.3  Persons who use Solyd's services (as defined in the Terms and Conditions).

5.3  The table below describes the purposes for which we process personal data, the data types involved, the legal basis, and the retention period for each purpose:

5.4  Whether you decide to provide your personal data to us is entirely voluntary unless required by law. We note that in cases where you do not provide personal data, we may not be able to provide certain services or the quality of services may be lower due to technical reliance on your data.

5.5  Personal data is processed only as long as necessary to fulfil the purpose for which it was collected. After the retention period expires, the data is anonymised so that data reconstruction is no longer possible.

6.Customer Support

6.1  We provide customer support through an AI-assisted chat tool and a ticketing/helpdesk system operated by external service providers. This system is used solely to receive, record, and manage customer inquiries and to facilitate communication with our support team. It does not make binding decisions about your rights, contractual relationship, or eligibility for our services.

6.2  Please do not use the chat or customer support system to submit sensitive information; if such information is nevertheless provided, we reserve the right to restrict or delete it where appropriate for your protection.

7.Issuance of Soulbound Tokens

7.1  We offer eligible customers the possibility to claim "Soulbound Tokens" ("SBTs") in connection with their purchases. SBTs can be claimed only by users who log in to their customer account on our website.

7.2  SBTs are issued to a digital wallet created for the customer through the third-party wallet infrastructure provider Privy. The SBT functions as a digital proof of certain interactions with our services and does not, in itself, determine or affect the customer's contractual rights, eligibility for services, or other legal position.

7.3  Customers should not use the SBT functionality to submit or embed sensitive or special category data, and we may restrict or delete such data where appropriate for their protection.

8.What Are Cookies and How Do They Work

8.1  Cookies are small text files that a website stores on your computer when you visit it. They help provide a more user-friendly online environment.

8.2  There are first-party cookies and third-party cookies. First-party cookies are set by the website you are currently visiting, while third-party cookies are set by external entities on your device.

8.3  Session cookies are temporary and expire when you close your browser or end your session. Persistent cookies remain on your computer until you delete them or they expire on their own.

8.4  Depending on their purpose, cookies can be classified as essential, functional, analytical, or advertising cookies.

9.1  You can manage cookie settings on our website using the cookie settings tool, which appears as a pop-up window. With this tool, you can consent to the use of specific categories of cookies. 10.Sharing Personal Data with Third Parties

10.1  We share your personal data with contractual processors, such as our business development partners, product-design partners, licensees, developer contractors, mass email senders, server provider(s), website and webshop hosting services provider(s), wallet infrastructure provider, accounting services, legal consultants, payment providers, and similar.

10.2  Personal data is disclosed to third parties only when necessary to fulfil the purpose of personal data processing. Third parties may access and process your personal data only to the extent and in the manner specified in the contract we have concluded with them and in accordance with purposes stated in this privacy policy.

10.4  Government Data Sharing. In some circumstances we are legally obliged to share information with public authorities or law enforcement. For example, we may be required to provide information related to a court order or where we must cooperate with supervisory authorities in handling complaints or investigations. In any scenario, we will attempt to satisfy ourselves that we have a lawful basis on which to share the information, document our decision making, and satisfy ourselves we have a legal basis on which to share the information.

10.5  We may also share information in the event of non-payment including a monetary penalty or court ordered costs. If the debt remains outstanding after the specified timeframe for payment, no payment plan is in place or an agreed payment plan is not being adhered to, we may initiate formal proceedings to recover the full amount of the unpaid penalty.

10.6  As a result, Solyd will share Personal Data with the litigation and recovery specialists it instructs in order for them to identify assets and undertake recovery action through the courts.

11.International Data Transfers

11.1  Our servers are located within the EU. Nonetheless, your personal data may be transferred, stored, and processed outside your country of residence. When transferring your data outside of the EU, we use recognised transfer mechanisms, such as the European Commission's Standard Contractual Clauses or equivalent agreements that have been approved, unless the destination country has been deemed to provide an adequate level of data protection.

12.How We Protect Your Personal Data

12.1  Our company strives to achieve an adequate level of personal data protection. To achieve this, we have adopted various technical and organisational measures, including:

12.1.1  regularly updating our hardware and software;

12.1.2  securing hardware and software with protective software;

12.1.3  practising and implementing privacy by design coding and development;

12.1.4  protecting our business premises;

12.1.5  restricting unauthorised access to personal data with passwords and clear competence division;

12.1.6  monitoring employees;

12.1.7  having appropriate contractual arrangements in place with all individuals who have access to your personal data.

12.2  Despite our security mechanisms, we acknowledge that a security incident may occur. For this purpose, we have developed a specific protocol to address such incidents quickly, effectively, and in compliance with the law.

12.3  If a security incident occurs that may threaten the rights and freedoms of individuals, we will immediately notify the competent supervisory authority, but in no case later than 72 hours after becoming aware of the incident. If a major security incident occurs that could negatively impact a customer's personal data and privacy, the affected customer or individual will also be notified.

13.Your Rights

13.1  Regarding the processing of your personal data, you have the following rights:

13.1.1  Right of Access: You have the right to information about whether we process your personal data, what data we process, how we obtained it, the purpose of processing, retention time, whether automated decision-making or profiling is performed, to whom the data is transferred, and whether it is transferred outside the EU/EEA area, as well as what security measures have been implemented.

13.1.2  Right to Rectification: You have the right to request the correction or completion of inaccurate, incomplete, or outdated personal data we process about you.

13.1.3  Right to Portability: You can request that we provide your personal data in a structured and machine-readable format, if technically feasible.

13.1.4  Right to Erasure: You have the right to request the deletion of your personal data without undue delay, especially if you withdraw your consent. However, there are situations where we cannot comply with your request, for example, if the processing is based on a valid contractual relationship or legal obligations.

13.1.5  Right to Restrict Processing: You have the right to request a temporary restriction on the processing of your personal data, e.g., for the duration of the correction of personal data we process about you.

13.1.6  Right to Withdraw Consent: Whenever our processing of your data is based on your consent, you can withdraw such consent without any negative consequences for you. After withdrawing your consent, we will no longer process your personal data for the purpose for which you provided consent.

13.1.7  Right to Object: You have the right to object to the processing of personal data when it comes to processing for direct marketing purposes, including profiling.

13.1.8  Right to Data Portability: In technically feasible cases, you can request that your personal data be transferred to another controller.

13.1.9  Right to not be discriminated against: We cannot deny you services or have different terms of services towards you merely on the grounds that you either denied consent or exercised your rights in accordance with applicable data protection law. However, by not consenting or exercising your rights (such as deletion of your personal data, restriction of processing, etc.), we may not be able to provide you with certain services or the quality of provided services may vary due to technical restrictions brought upon by your choices.

13.1.10  Right to lodge a Complaint with the Information Commissioner: This right is exercised if you believe there has been a violation of data protection by the controller. You can submit a complaint to the local Information Commissioner.

13.2  You can exercise your rights by writing to us via email at support@solyd.store with the subject "data protection" or by sending your request by post to:

13.3  We will process your request as soon as possible and no later than 30 days from receipt. If a particular request is so extensive that it requires a longer resolution time, we will inform you in advance and provide you with an estimated response time.

13.4  We reserve the right to reliably identify you when submitting a request to exercise any of your rights. If you do not send us personal data with your request that would allow us to reliably identify you, we will ask you for additional personal data. If you do not provide us with additional personal data within the specified period, we will dismiss your request.

14.Online Plug-ins and Hyperlinks

14.1  Our website provides the option to use online plug-ins and hyperlinks. Please note that these plug-ins and the content on the hyperlinks are operated by third parties and Solyd has no control over their content, privacy and/or security.

14.2  The use of online plug-ins and hyperlinks is at the user's own risk. Each plug-in and/or hyperlink controller operates based on its own privacy rules, which are not associated with the controller's rules.

14.3  Responsibility for interacting with the plug-ins and hyperlinks and any consequences arising from such interaction lies solely with the individual.

15.Automated Processing and Profiling

15.1  Because we aim to provide you with the most relevant content, we create a profile with your consent, which serves as the basis for personalised communication. The data controller performs automated decision-making and profiling.

15.2  If you do not wish the controller to carry out automated decision-making and profiling using your personal data, you may withdraw your consent for such processing. In that case, we will cease processing your personal data.

15.3  It is important to emphasise that this does not involve automated decision-making that produces legal effects concerning you or significantly affects you. The profiling consists solely of purchase suggestions and customised newsletters based on previous purchases.

15.4  By creating an account, you consent to such profiling. If you do not wish to continue with profiling, please send us a request via email to support@solyd.store.

16.1  Any changes to our Privacy Policy shall be published on this website.

16.2  It is assumed that you agree to the new version of the Policy if you continue to use Solyd or other services subject to this Policy after the Policy has been changed.
